ORANGE GROVE VETERINARY HOPITAL’S TERMS AND CONDITIONS

Please note that the Orange Grove Veterinary Hospital Terms and Conditions is to be read in conjunction with the Orange Grove Veterinary Hospital Privacy Policy and Orange Grove Veterinary Hospital Delivery and Returns Policy as part of the Agreement between you and Orange Grove Veterinary Hospital.

These Orange Grove Veterinary Hospital Terms and Conditions constitute a legally binding contract between you and Vet’s Pantry and are enforceable against each and every user accessing the Orange Grove Veterinary Hospital website.

These terms and conditions govern your use and any purchases of any products off the Orange Grove Veterinary Hospital website. Use of the Orange Grove Veterinary Hospital Site

 

1. By accessing the Orange Grove Veterinary Hospital website and purchasing any of our products, you warrant that you are legally entitled to do so. When accessing the website, you may do so in order to browse the content or to make legitimate purchases.

Vet’s Pantry’s Rights

 

Orange Grove Veterinary Hospital reserves the right to:

1. Adjust product prices without notice as and when we deem fit;

 

2. Amend and /or temporarily or permanently withdraw the website without notice to you for whatsoever purpose. Such an amendment or withdrawal not resulting in any incurred liability for Orange Grove Veterinary Hospital;

 

 

3. Amend, add to or delete from these terms and conditions as and when Orange Grove Veterinary Hospital considers it necessary. Following such a change, your continued use of the Orange Grove Veterinary Hospital website will be deemed an acceptance of the updated terms and conditions which automatically supersede and replace the previous terms and conditions. In the event that you do not agree to the updated terms and conditions, then you must immediately cease using the Orange Grove Veterinary Hospital website; and

 

4. Maintain the website as and when necessary. Orange Grove Veterinary Hospital will not compensate any customers in the event that they are unable to use the website for whatsoever reason due to maintenance purposes and / or circumstances beyond our control.

 

Orders, Confirmation and delivery

 

Please note the following:

1. The advertising of products of the Orange Grove Veterinary Hospital website does not constitute a guarantee that the product will be available, but merely serves as an offer to purchase the product. Products are subject to stock availability.

 

2. In the event that products are no longer available despite a successful order being placed, Orange Grove Veterinary Hospital will notify you and will refund you in full.

 

3. Orange Grove Veterinary Hospital cannot be held liable for any erroneous information displayed on our website, unless such liability arises as a result of gross negligence or misconduct on the part of an Orange Grove Veterinary Hospital employee. Please note that in the event that a product is erroneously priced on the Orange Grove Veterinary Hospital website, we will be under no obligation to sell the product at the erroneous price. 4. Orange Grove Veterinary Hospital reserves the right to cancel any order for whatsoever reason necessary and undertakes to notify you of the cancellation thereof in the event of a cancellation.

 

5. Although the Orange Grove Veterinary Hospital website does send confirmation receipts of orders, unforeseen technical glitches may arise, and in such an event, please note that you must not resend your instruction as this may result in duplicate transactions for which you may be held liable.

 

6. A transaction will only be considered complete once the product and / or service has been delivered and / or completed. Orange Grove Veterinary Hospital will deliver the products to you and only on delivery, will an agreement of sale come into effect between yourself and Orange Grove Veterinary Hospital. Accordingly, risk passes to you on delivery.

 

7. Placing products into your basket does not constitute an order and such products may be removed from your basket if stock is depleted.

 

8. Delivery times are estimated time frames and accordingly, Orange Grove Veterinary Hospital cannot be held liable for any variance in delivery time.

 

9. Orange Grove Veterinary Hospital reserves the right to request identity verification upon payment.

 

Payment methods:

 

1. Orange Grove Veterinary Hospital accepts payment via EFT, credit card and / or debit card. The full amount owed shall be debited against your card of choice during the check-out process. In the event that EFT payment is made, it must be an instant EFT and such a payment shall be processed in the same manner as a credit card payment.

 

2. Payment will be processed on acceptance of your order and prior to delivery.

 

3. In submitting your order, card details and your identification information, you warrant that you have the necessary legal capacity to do so and that you are fully authorised and entitled to make payment and furthermore that there are sufficient funds in your account in order to do so. If Orange Grove Veterinary Hospital does not receive authorisation, the order and transaction will be cancelled and your account will not be debited.

 

4. In the event that payment is made via credit card, please note that we may require additional information from you in order to verify the validity of the payment. Orange Grove Veterinary Hospital reserves the right to withhold delivery of the products should you fail to provide the required information.

Cancellations

 

1. In terms of section 44 of the Electronic Communications and Transactions Act, 25 of 2002, you are entitled to cancel your order of any Orange Grove Veterinary Hospital products within 7 (seven) days of receipt thereof, provided the products have not been utilised or damaged by yourself in any form whatsoever. In the event of such a cancellation, you will be refunded in full within a period of 30 (thirty) days of the date of your cancellation and you undertake not to utilise the products in any manner whatsoever.

 

2. In the event of cancellation, your agreement of purchase will be deemed cancelled and you will be liable for the costs of returning any Orange Grove Veterinary Hospital products, including but not limited to courier and/ or shipping charges under section 44(2) of the Electronic Communications and Transactions Act, 25 of 2002.

 

3. If you would like to cancel an order, your cancellation must be done by way of email on orders@ogvh.co.

 

4. In the event that you cancel an order later than 7 (seven) days after receipt of any Orange Grove Veterinary Hospital products, Orange Grove Veterinary Hospital reserves the right to debit your account for the delivery fees in respect of any late cancellations.

 

5. In the event that you cancel payment, or that your card ceases to be valid for whatsoever reason, you will remain liable for the full purchase price, including all costs incurred by Orange Grove Veterinary Hospital for the recovery thereof.

 

6. Orange Grove Veterinary Hospital reserves the right to cancel any sale and / or your registration in the event that you breach any of the terms and conditions contained herein.

 

Promotional Vouchers or discounts

 

1. Orange Grove Veterinary Hospital may on occasion offer promotional vouchers or discounts on our website. Such promotional vouchers and discounts may only be redeemed for the duration of their validity, upon expiry, they may not be redeemed.

 

2. Promotional vouchers or discounts are offered at Orange Grove Veterinary Hospital’s sole discretion and we reserve the right to amend, cancel or reject a promotional voucher or discount for whatsoever reason.

 

3. Please note that each promotional vouchers or discount may only be used once.

 

4. Promotional vouchers or discounts may only be used at check-out within the time frame specified for the promotional voucher or discount. Accordingly, they cannot be used for future orders.

 

5. Promotional vouchers and discounts will be set off against the purchase price upon acceptance of the order and check-out. In the event that your promotional voucher does not work for whatsoever reason, you can contact Orange Grove Veterinary Hospital by way of email on orders@ogvh.co.za where one of our friendly staff members will assist you.

 

6. Orange Grove Veterinary Hospital is not liable for any loss or unauthorised use of a promotional voucher or discount.

 

Copyright and Intellectual Property Rights

 

1. Copyright and intellectual property rights in terms of all content made available on the Orange Grove Veterinary Hospital website is owned by Orange Grove Veterinary Hospital, and accordingly the use thereof is protected by South African law and international intellectual property law.

 

2. General

1. These terms and conditions, read in conjunction with the Privacy Policy and the Delivery and Returns Policy constitute the sole agreement between you and Orange Grove Veterinary Hospital in relation to your use of the Orange Grove Veterinary Hospital website. No variance in any form whatsoever of the above-mentioned agreement will be accepted unless consented to in writing by both you and Orange Grove Veterinary Hospital.

 

2. Neither you nor Orange Grove Veterinary Hospital may cede, assign or delegate any of its rights or obligations in terms of this agreement (the Terms and Conditions, Privacy Policy and Delivery and Returns Policy).

4. Orange Grove Veterinary Hospital cannot be held liable for any loss arising from or in connection with any event of force majeure. In the event of force majeure, Orange Grove Veterinary Hospital reserves the right to terminate all of its right and or obligations by way of notice to you.

 

5. When you use the Orange Grove Veterinary Hospital website, you consent to receiving electronic communications from us.

 

Dispute Resolution

 

1. This agreement (the Terms and Conditions, Privacy Policy and Delivery and Returns Policy) shall be governed by the laws of the Republic of South Africa.

 

2. Any dispute arising in connection with the use of the Orange Grove Veterinary Hospital website will be submitted to and determined by arbitration.

 

 

3. The arbitration will remain confidential between you and Orange Grove Veterinary Hospital and the arbitration will be held at the Arbitration Foundation of Southern Africa, Johannesburg and shall be governed by the rules of the Arbitration Foundation of Southern Africa. The arbitration award will be binding on both you and Orange Grove Veterinary Hospital alike.
